1. These terms

These Terms and Conditions govern your use of whoslegacy.com and every service we provide through it, including applications, early access places, paid profile features, interviews and the newsletter.

By using the site, submitting an application, or taking part in a profile, you accept these terms. If you do not accept them, please do not use the site.

Please also read our Privacy Policy, which explains how we handle personal information and forms part of these terms.

2. Who we are

Who's Legacy is a digital publication published by [FAZINFLO LEGAL ENTITY NAME], a [ENTITY TYPE] registered in [COUNTRY] under number [NUMBER], registered office [FULL ADDRESS].

"We", "us" and "our" mean that entity. "You" means the person using the site or taking part in a profile. If you are acting for a company, "you" means both you and that company, and you confirm you have authority to bind it.

3. What Who's Legacy is

Who's Legacy is an editorial publication. We document founders, entrepreneurs and builders through long-form profiles, interviews and photography, published as a digital magazine and archived permanently.

What we are not. We are not an investor, an accelerator, a marketing agency, a PR service, a recruiter or an adviser. Nothing we publish is investment, legal, financial, tax or business advice, and nothing in a profile is an endorsement, a recommendation, a rating, or a statement that any business is a good investment.

Being featured is a piece of editorial coverage. It is not an award, a certification, an accreditation, or a verification of any claim a subject makes.

4. Using the website

You may read, link to and share our published material for personal, non-commercial purposes.

You may not: copy, republish or redistribute substantial parts of the publication without written permission; scrape, crawl or harvest content or personal data, including for training machine learning models, except as permitted in Section 13; frame or mirror the site; remove credits, bylines or watermarks; interfere with the site's security or availability; or use the site unlawfully.

We may suspend or withdraw access to the site or any part of it at any time, and we do not guarantee that it will always be available or uninterrupted.

5. Eligibility

To apply, take part in a profile, or buy anything from us, you must be at least 18 years old and legally able to enter a contract.

Founders under 18. We do profile young founders, and some are under 18. If a subject is under 18 or under the age of majority where they live, a parent or legal guardian must apply on their behalf, must agree to these terms, and must give written consent before any interview, recording, photography or publication. That consent can be withdrawn — including after publication, in which case we will remove the profile.

You must give accurate and complete information when you apply, and keep it up to date.

6. Applications and selection

Applying is free and creates no contract. Submitting the form does not entitle you to a profile, a reply, or a place in any issue.

Selection is ours alone. We decide who to feature, on editorial grounds. We may decline any application without giving a reason, and we may stop a project at any stage before publication.

Selection cannot be bought. No payment, offer, gift, advertising spend or other inducement will secure a place in the publication or affect editorial judgement. See Section 9.

We may verify what you tell us. We fact-check, and we may ask for evidence of claims — founding dates, team size, customer numbers, funding, revenue, awards. If we cannot verify a material claim, we will not print it. If we find you have given us materially false information, we may withdraw an offer, cancel a project without refund, or remove a published profile.

7. The Founding 100 offer

We are currently offering a profile free of charge to the first 100 founders we select, against a standard fee of [$999 USD].

The following apply:

• The offer is limited to 100 selected founders, counted by the date we confirm a place in writing — not by the date you applied.
• Applying does not reserve a place. A place exists only once we confirm it by email.
• The offer covers [SPECIFY EXACTLY WHAT IS INCLUDED — e.g. one interview of up to 90 minutes, one written profile of up to 2,500 words, one photography session or use of supplied images, design and layout, publication in one issue, a shareable PDF and social images].
• It does not cover [SPECIFY EXCLUSIONS — e.g. travel costs, commissioned original photography on location, additional revisions beyond those in Section 8, print copies, translation, ongoing coverage].
• The offer is not transferable and cannot be exchanged for cash or credit.
• We may change, pause or withdraw the offer at any time before confirming your place. Once confirmed, we will honour it.
• [Scheduled launch: 1 January 2027. Dates are targets, not commitments — see Section 8.]

8. Paid profiles, payment and refunds

Where a fee applies:

Price and tax. The fee is [$999 USD] unless we agree otherwise in writing. Prices exclude any applicable taxes, which will be added at checkout. [Indian customers: GST at the applicable rate will be charged.]

Payment. Payment is due [in full before production begins / 50% on confirmation and 50% before publication], through our payment provider [PROVIDER]. We do not store your card details.

What you are paying for. The fee covers production — interviewing, writing, editing, fact-checking, photography, design and publication. It does not buy selection, favourable coverage, approval rights beyond those in this section, or any guaranteed outcome.

Cancellation by you. You may cancel in writing at any time before publication.

• Before the interview: full refund, less [any non-recoverable costs already incurred].
• After the interview but before the draft is sent: [50%] refund.
• After the draft is sent: no refund, as the work is substantially complete.

Statutory withdrawal rights. If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a distance contract. Because production begins promptly at your request, you will be asked to acknowledge that performance starts within the withdrawal period and that you lose the right to withdraw once the service is fully performed. You may still cancel during production and pay only for what has been done.

Cancellation by us. We may cancel and refund in full at any time before publication if we decide not to proceed on editorial grounds. If we cancel because you gave us materially false information, breached these terms, or failed to take part after reasonable attempts to schedule, no refund is due.

Late or failed payment. We may suspend work and withhold publication until payment is received.

9. Editorial independence and disclosure

Because money can change hands, we want this to be unambiguous.

What the fee is for. The fee pays for the work of making a profile. It does not pay for selection, and it does not pay for the profile to be positive.

What we control. We control the final text, headline, images, layout, framing and whether we publish at all. Editorial judgement is not for sale.

What you control. You control what you choose to tell us, and you may ask us to correct facts. See Section 10.

Disclosure. Where a subject has paid a fee, we label the profile accordingly, in a clear and prominent way that a reader will see before or alongside the content. [SPECIFY THE LABEL YOU WILL USE — e.g. "Produced with a participation fee" or "Founder-funded profile".] We do this because laws on advertising and endorsements in several countries — including the FTC Act in the United States, the CAP Code in the United Kingdom, and ASCI's guidelines in India — require material connections between a publisher and a subject to be disclosed.

No pay-for-placement. We do not sell cover positions, rankings, order of appearance, or inclusion in any list.

Advertising and sponsorship. Any advertising or sponsored content we carry will be clearly identified as such and kept visually distinct from editorial.

10. Making the profile

Scheduling. We will agree interview and shoot dates with you. If you miss agreed sessions without reasonable notice more than [twice], we may end the project.

Recording. Interviews are recorded. You will be told before recording begins, and consent to recording is a condition of taking part. See our Privacy Policy, Section 5.

Your review. Before publication we will send you the draft. You will have [5 business days] to respond, and you may:

• Correct factual errors — we will always fix these
• Flag anything confidential you did not mean to share — we will remove it if it is genuinely sensitive
• Suggest changes to tone, framing or emphasis — we will consider these but we are not obliged to make them

You may not rewrite the piece, veto the headline, require removal of accurate information that is unflattering, or approve or reject publication. If we do not hear from you within the review window, we may publish as drafted.

Timelines. Any dates we give for interview, draft, publication or launch are estimates in good faith, not guarantees, and we are not liable for delay. [The stated launch date of 1 January 2027 is a target.]

We may decline to publish at any point, for editorial or legal reasons. If we do so and a fee has been paid, we will refund it in full.

11. Rights you give us

By taking part, you grant us a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to use, reproduce, publish, distribute, adapt, translate, excerpt, archive and display:

• Your name, likeness, voice, image, photographs and biographical details
• Statements you make in the interview, including quotations
• Materials you supply to us — logos, images, documents, data
• The profile itself, in digital, print and any future format

for the purposes of publishing Who's Legacy, promoting the publication and its issues, and maintaining the archive.

This licence is perpetual and irrevocable because the archive is permanent. It is not a transfer of ownership — you keep whatever rights you already had in your own materials.

You promise us that:

• The information you give us is true, accurate and not misleading
• You own or are licensed to give us everything you supply, including photographs you did not take yourself
• Our use of your materials will not infringe anyone's copyright, trade marks, privacy, publicity or confidentiality rights
• You have permission from anyone else identifiable in materials you supply
• Taking part does not breach any agreement you have, including any employment, investor, confidentiality or non-disclosure obligation
• Nothing you tell us is confidential information belonging to someone else

Your obligation to tell us. If you become aware that something published about you is wrong, tell us promptly so we can correct it.

12. Rights we give you

We want you to share your profile. Subject to your account being in good standing:

You may link to your profile anywhere; share the shareable images and PDF we provide on social media, in newsletters, in pitch decks and in investor materials; quote from your own profile with attribution to Who's Legacy; and say truthfully that you have been profiled by Who's Legacy.

You may not alter, crop or edit the profile, spread images or PDF in a way that changes their meaning or removes our masthead or credits; present the profile as an award, endorsement, ranking, certification or investment recommendation; use our name, masthead or marks in a way that implies partnership, sponsorship or approval of your business; sell or license the profile to anyone else; or use the profile in advertising for a regulated product or service without our written consent.

We may withdraw this permission if it is misused.

13. Our intellectual property

Everything in the publication other than your own materials — the written profiles, photography we commission, the masthead, name, logo, design system, page layouts, the Legacy Questions format, and the site itself — is owned by us or our licensors and protected by copyright, trade mark and other laws.

You may not reproduce it beyond what Section 4 and Section 12 allow, or what copyright law permits for quotation, criticism, review and news reporting with attribution.

Text and data mining. We expressly reserve all rights to use of our content for text and data mining and for training artificial intelligence or machine learning models. No licence for those purposes is granted, whether by these terms, robots.txt, or your access to the site.

14. Nominations and material you send us

If you nominate someone else, you confirm that the information you give us is accurate to the best of your knowledge, that you are entitled to share it, and that you are not doing so maliciously.

Anything you send us unsolicited — pitches, suggestions, ideas, story tips — is sent on a non-confidential basis, and you grant us a licence to use it. We may already be working on something similar, and we owe you nothing for it. We will still treat genuinely sensitive information sensibly.

15. Corrections, complaints and removal

Corrections. If we get a fact wrong, tell us at [editor@whoslegacy.com]. We will investigate, and where we are wrong we will correct the piece promptly and add a visible correction note where the change is material.

Complaints. If you believe something we published is inaccurate, unfair or unlawful, write to [editor@whoslegacy.com] setting out what you say is wrong and why. We will respond within [10 business days]. A person will read it.

Removal. We keep an archive, and we will normally decline removal requests. We will remove or amend where content is unlawful, where a parent withdraws consent for a subject who was under 18, where publication creates a genuine risk of harm to someone's safety, or where a court orders it.

Right of reply. If we publish something materially critical of you, we will offer you a fair opportunity to respond.

16. Third-party links and content

We link to third-party websites and reproduce third-party materials such as company logos. We do not control or endorse them, and we are not responsible for their content, products, or practices. Your dealings with third parties are between you and them.

17. Disclaimers

The site and its content are provided "as is". To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out here, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the site will be uninterrupted, secure or error-free, that content is complete or up to date, or that any result will follow from being profiled — including press attention, investment, customers, hires or opportunities of any kind.

Statements made by subjects are theirs, not ours, and we do not adopt or verify every claim a subject makes about their own business.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

18. Our liability

Subject to the paragraph above:

• We are not liable for indirect, special, incidental, consequential or punitive loss; loss of profit, revenue, business, goodwill, reputation, opportunity or anticipated savings; or loss or corruption of data — whether or not foreseeable.
• Our total liability to you for all claims arising out of or connected with these terms, the site, or any profile is limited to the greater of [the amount you actually paid us in the 12 months before the claim] or [$100 USD].
• If you are a consumer, nothing here affects your statutory rights.

19. Your indemnity

You will indemnify us against all claims, damages, losses, liabilities, costs and reasonable legal fees arising from: your breach of these terms; any information or material you give us that is inaccurate, misleading, unlawful, confidential to someone else, or infringes a third party's rights; any claim brought by a third party in relation to your profile; and your misuse of the publication or our marks.

20. Suspension and termination

We may suspend or terminate your access, withdraw an offer, cancel a project, or remove a profile if you materially breach these terms, give us materially false information, misuse the licence in Section 12, or behave abusively toward our team or contributors.

Sections 11, 13, 17, 18, 19 and 21 survive termination. Termination does not require us to remove already-published material from the archive.

21. Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of [INDIA / STATE / COUNTRY], without regard to conflict of law rules.

The courts of [CITY, COUNTRY] have [exclusive / non-exclusive] jurisdiction.

If you are a consumer resident in the EEA or UK, you keep the benefit of any mandatory protections and the right to bring proceedings in your own country of residence.

Before starting proceedings, please contact us at [legal@whoslegacy.com] so we can try to resolve it. [Optional: disputes may be referred to arbitration in [SEAT] under the [Arbitration and Conciliation Act, 1996 / other rules], by a single arbitrator, in English.]

22. General

Whole agreement. These terms, the Privacy Policy, and any written confirmation of your place or order form the entire agreement between us.

Changes. We may update these terms. Material changes will be posted here with a new date, and we will email anyone with an active project or order before they take effect. Continuing to use the site after that means you accept the change. The terms in force when your project was confirmed govern that project.

No waiver. If we do not enforce a right, we do not give it up.

Severability. If any provision is found unenforceable, the rest stands.

No partnership. Nothing here creates a partnership, agency, joint venture or employment relationship.

Assignment. You may not assign your rights without our consent. We may assign ours to a successor of the publication.

Third parties. No one other than you and us has any right to enforce these terms.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.
